Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://pbcbuildings.com and any related pages, forms, quote requests, comment features, and online services we operate (collectively, the “Site”). The Site is operated by Pioneer Pole Buildings, Inc., doing business as Pioneer Buildings (“Pioneer Buildings,” “PBC,” “we,” “us,” or “our”).

By accessing or using the Site, submitting a form, requesting information, requesting a quote, leaving a comment, or otherwise interacting with us through the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• use the Site in any way that violates applicable law or regulation;
• submit false, incomplete, or misleading information;
• attempt to gain unauthorized access to any part of the Site, related systems, or networks;
• interfere with the operation, security, or performance of the Site;
• use the Site to transmit spam, malware, malicious code, or other harmful content; or
• copy, scrape, reproduce, distribute, or exploit Site content for commercial purposes without our prior written permission.

We reserve the right to suspend, restrict, or terminate access to the Site at any time, without notice, if we believe a user has violated these Terms or is using the Site in a harmful, unlawful, or unauthorized manner.

2. Informational Purpose Only

The Site is provided for general informational purposes only. Service descriptions, project examples, gallery content, technical information, pricing references, estimated timelines, financing references, service-area content, and other Site content may change at any time without notice.

We make reasonable efforts to keep the Site current, but we do not guarantee that any Site content is complete, accurate, current, available, or error-free at all times.

3. Requests Only: No Contract Created

The Site is for request and inquiry purposes only. Submitting a contact form, quote request, financing inquiry, comment, or other form through the Site does not create a binding contract, confirmed booking, guaranteed price, guaranteed start date, or guaranteed service availability.

Any response provided through the Site or through follow-up communications is preliminary unless and until Pioneer Buildings confirms the matter in writing and, where applicable, the customer enters into a separate written contract, proposal, invoice, work order, warranty document, waiver, financing document, or other agreement required by us.

We reserve the right to accept or decline any request, correct errors, request additional information, and determine final pricing, scheduling, scope, availability, and serviceability in our sole discretion.

4. Separate Contracts Control

Any actual building, construction, restoration, barndominium, garage, equestrian, municipal, recreational, agricultural, steel-building, or related project associated with Pioneer Buildings may be governed by a separate written contract, proposal, work authorization, invoice, warranty document, waiver, or service agreement issued by Pioneer Pole Buildings, Inc. d/b/a Pioneer Buildings.

Those separate documents, not this Terms of Service page, will govern the specific terms of the transaction, including pricing, deposits, materials, scheduling, change orders, warranties, project scope, limitations, cancellations, and customer responsibilities.

If there is any conflict between these Terms and a separate written agreement entered into for a project, the separate written agreement will control for that transaction.

5. Service Area and Licensing

Pioneer Buildings serves the Mid-Atlantic region, including Pennsylvania, New York, New Jersey, Delaware, Maryland, Virginia, and West Virginia.

Pioneer Pole Buildings, Inc. is licensed to operate in the following states:

Actual project availability may depend on location, scope, scheduling, site conditions, and applicable legal or permitting requirements.

6. Financing

The Site may provide information about financing options and may link users to third-party financing providers, including Hearth. Financing applications, pre-qualification, approvals, rates, terms, and funding decisions are handled by the applicable third-party financing provider, not through this Terms of Service page.

Pioneer Buildings does not control third-party financing terms, credit decisions, privacy practices, or platform availability.

7. Age Requirement

The Site is intended for use by individuals who are 18 years of age or older.

By using the Site, you represent that you are at least 18 years old.

8. Communications: Email, Calls, and SMS

By submitting a form or contacting Pioneer Buildings through the Site, you consent to receive communications from us regarding your inquiry, project, request, scheduling, or other matter by phone, email, and/or text message, to the extent permitted by law.

You represent that any contact information you provide is accurate and that you are authorized to provide it.

9. User Submissions

If you submit or upload any information, files, photos, documents, comments, project details, or other materials through the Site (“Submissions”), you represent and warrant that:

• You have the right to provide the Submissions.
• The submissions are accurate to the best of your knowledge.
• The Submissions do not violate any law or third-party right; and
• The Submissions do not contain malicious, unlawful, defamatory, or harmful material.

You grant Pioneer Buildings a non-exclusive, worldwide, royalty-free license to use, review, store, copy, transmit, and otherwise process your Submissions as reasonably necessary to:

• Respond to your inquiry or request.
• Evaluate your project or service needs.
• Provide customer support;
• Operate and improve our business;
• Document communications and work; and
• Protect our legal and business interests.

10. Photos, Videos, and Project Documentation

We may take, receive, store, and use photos and videos relating to estimates, job sites, work in progress, completed work, and related business operations for documentation, recordkeeping, training, quality control, operational purposes, and marketing, subject to applicable law and our Privacy Policy.

11. Comments

The Site may allow comments, reviews, or similar public submissions on certain pages. If comments are available, you are responsible for the content you post.

We may, but are not required to, review, remove, moderate, disable, or refuse any comment or submission at our discretion.

12. Intellectual Property

The Site and all content on it, including text, graphics, branding, logos, layouts, design elements, images, videos, downloads, and other materials, are owned by or licensed to Pioneer Buildings and are protected by applicable intellectual property laws.

You may use the Site only for your personal, non-commercial use in learning about Pioneer Buildings or submitting a legitimate request or inquiry. You may not reproduce, distribute, modify, display, publish, create derivative works from, or exploit Site content without our prior written consent.

13. Third-Party Services and Links

The Site may contain links to or rely on third-party websites, embedded content, financing tools, maps, review platforms, analytics tools, advertising tools, communication tools, accessibility tools, translation tools, hosting providers, or social media integrations.

We do not control and are not responsible for the content, availability, privacy practices, terms, or actions of third parties. Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.

14. Disclaimers

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, PIONEER BUILDINGS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

WE DO NOT WARRANT THAT:

• THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
• THE SITE WILL ALWAYS BE AVAILABLE;
• ANY REQUEST SUBMITTED THROUGH THE SITE WILL BE RECEIVED OR ACTED UPON BY A PARTICULAR TIME; OR
• ANY INFORMATION OR CONTENT ON THE SITE WILL ALWAYS BE COMPLETE, CURRENT, OR FREE OF ERRORS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIONEER POLE BUILDINGS, INC. D/B/A PIONEER BUILDINGS AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, AFFILIATES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIONEER BUILDINGS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED $100.

NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

16. Indemnification

You agree to defend, indemnify, and hold harmless Pioneer Pole Buildings, Inc. d/b/a Pioneer Buildings and its owners, officers, employees, agents, representatives, affiliates, contractors, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your use of the Site;
• Your violation of these Terms;
• Your Submissions;
• Your violation of any law or third-party right; or
• Any false, misleading, or unauthorized information you submit through the Site.

17. Privacy

Your use of the Site is also subject to our Privacy Policy, which describes how Pioneer Buildings collects, uses, and handles personal information. By using the Site, you acknowledge and agree to our Privacy Policy.

18. Changes to the Site or These Terms

Pioneer Buildings may update, revise, suspend, or discontinue all or any part of the Site at any time, without notice.

We may also revise these Terms from time to time. Any updated Terms will become effective when posted on the Site with the revised effective date. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the revised Terms.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.

20. Dispute Resolution and Venue

If a dispute arises out of or relates to the Site or these Terms, you agree to contact Pioneer Buildings first and attempt to resolve the matter informally.

If the dispute cannot be resolved informally, any legal action arising out of or relating to the Site or these Terms shall be brought exclusively in a state or federal court located in Pennsylvania, unless applicable law requires otherwise.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

22. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or of any other provision.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pioneer Buildings regarding your use of the Site.
